THE ISLAND<\/h2>\n\n<p>1.1 Albarella is a residential island under private law.<\/p>\n\n<h2>Art. 2 \u2013 ADMITTANCE<\/h2>\n\n<p>2.1 The following persons shall have the right of admittance and stay on the island:<\/p>\n\n<ul>\n  <li>property owners, including Albarella S.r.l.;<\/li>\n  <li>close family members of the property owners.<\/li>\n<\/ul>\n\n<p>2.2 The following persons shall obtain the right of admittance and stay on the island:<\/p>\n\n<ul>\n  <li>property tenants and their family members as specified above;<\/li>\n  <li>in general, any person allowed to stay on the island by property owners;<\/li>\n  <li>guests staying at \u201cHotel Capo Nord\u201d and \u201cGolf Hotel\u201d;<\/li>\n  <li>persons staying on the island due to and for the execution of a continuous employment relationship with owners or tenants, limited to the duration of such service.<\/li>\n<\/ul>\n\n<p>2.3 The following persons shall obtain the right of admittance and temporary presence on the island:<\/p>\n\n<ul>\n  <li>persons carrying out activities on the island on behalf of owners or tenants, limited to the time necessary for such activities;<\/li>\n  <li>in general, persons admitted to the island by property owners;<\/li>\n  <li>owners of a mooring place at the Tourist Port of Albarella who have received a daily admittance permit from the Port Management.<\/li>\n<\/ul>\n\n<h2>Art. 3 \u2013 PASSES AND ACCESS CARDS \u2013 SECURITY CONTROLS<\/h2>\n\n<p>3.1 The right of admittance and stay on the island shall be documented through the issuance, by the Association, of personal and non-transferable access permits\/passes.<\/p>\n\n<p>All access methods are strictly subject to the existence and continuity of the following requirements:<\/p>\n\n<ul>\n  <li>ownership of property on Isola di Albarella;<\/li>\n  <li>rental agreement;<\/li>\n  <li>employment relationship.<\/li>\n<\/ul>\n\n<p>The loss of these requirements results in the loss of the right of access and the deactivation of the related access methods.<\/p>\n\n<p><strong>Penalty: \u20ac 35.00<\/strong><\/p>\n\n<p>3.2 Temporary access to the island shall be documented through the delivery of an access permit\/pass indicating the validity period.<\/p>\n\n<p><strong>Penalty: \u20ac 35.00<\/strong><\/p>\n\n<p>3.3 Access permits\/passes shall be issued by the Association upon submission of written declarations from owners or authorized adult family members.<\/p>\n\n<p>3.4 Any person entitled to stay or temporary presence on the island must show the permit or communicate the access method to Security personnel.<\/p>\n\n<p>3.5 Persons found on the island without the right of admittance and\/or stay shall be requested to leave by Security personnel.<\/p>\n\n<h2>Art. 4 \u2013 ACCESS PERMITS\/PASSES FOR MOTOR VEHICLES<\/h2>\n\n<p>4.1 Each property owner shall receive access permits\/passes according to the following criteria:<\/p>\n\n<h3>FJORDS AND CONDOMINIUMS<\/h3>\n\n<p>One permit\/pass for each parking space purchased together with the property.<\/p>\n\n<h3>LOTS (built and unbuilt)<\/h3>\n\n<p>\nCubic meters (as calculated for condominium expenses)<br>\nDIVIDED BY<br>\n60 (legal cubic meters per person)<br>\nDIVIDED BY<br>\n3 (average number of persons per car)<br>\nROUNDED UP\n<\/p>\n\n<p>4.2 These permits\/passes are non-transferable.<\/p>\n\n<p><strong>Penalty: \u20ac 35.00<\/strong><\/p>\n\n<p>4.3 Access permits\/passes are valid yearly and issued only to owners who are up to date with condominium fee payments.<\/p>\n\n<h2>Art. 5 \u2013 ENFORCEMENT OF THE RULES<\/h2>\n\n<p>5.1 All owners are contractually bound to comply with these Rules.<\/p>\n\n<p>5.2 Any person obtaining the right of admittance and stay from a property owner automatically accepts all provisions of these Rules.<\/p>\n\n<p>5.3 All persons obtaining the right of admittance and\/or stay are required to comply with all related provisions and sanctions.<\/p>\n\n<p>5.4 The following signs must be displayed at the second gatehouse of the island:<\/p>\n\n<ul>\n  <li>a sign indicating that the island is private property;<\/li>\n  <li>a sign reading \u201cAccess reserved for authorized persons only\u201d.<\/li>\n<\/ul>\n\n<h2>Art. 6 \u2013 PARKING AND TEMPORARY STOPS<\/h2>\n\n<p>6.1 Parking of motor vehicles on the island is allowed exclusively in parking spaces inside or pertaining to private properties.<\/p>\n\n<p><strong>Penalty: \u20ac 35.00<\/strong><\/p>\n\n<p>6.2 Temporary stops are always allowed for loading\/unloading operations and work activities.<\/p>\n\n<p>6.3 Persons without an available parking space must leave their vehicles in the external parking areas outside the island entrance.<\/p>\n\n<p><strong>Penalty: \u20ac 35.00<\/strong><\/p>\n\n<h2>Art. 7 \u2013 TRAFFIC RULES<\/h2>\n\n<p>7.1 The ordinary means of transport on the island are:<\/p>\n\n<ul>\n  <li>bicycles;<\/li>\n  <li>community wheeled train;<\/li>\n  <li>community shuttle bus;<\/li>\n  <li>golf cars or quadricycles.<\/li>\n<\/ul>\n\n<p>7.2 Motorized traffic is generally prohibited.<\/p>\n\n<p><strong>Penalty: \u20ac 35.00<\/strong><\/p>\n\n<p>7.3 Motorized circulation is permitted:<\/p>\n\n<ul>\n  <li>for cars traveling to and from the assigned parking space;<\/li>\n  <li>in emergency situations;<\/li>\n  <li>for vehicles involved in work operations;<\/li>\n  <li>for service and public authority vehicles.<\/li>\n<\/ul>\n\n<p>7.4 Motorized circulation is tolerated:<\/p>\n\n<ul>\n  <li>for cars after sunset;<\/li>\n  <li>for mopeds and motorcycles during the permitted hours.<\/li>\n<\/ul>\n\n<p>7.5 Golf cars must be driven by properly licensed persons and be insured.<\/p>\n\n<p><strong>Penalty: \u20ac 50.00<\/strong><\/p>\n\n<p>7.6 Golf cars must comply with civil coexistence rules and road signage.<\/p>\n\n<p><strong>Penalty: \u20ac 50.00<\/strong><\/p>\n\n<p>7.7 Golf car owners are required to register the vehicle.<\/p>\n\n<p><strong>Penalty: \u20ac 50.00<\/strong><\/p>\n\n<p>7.8 Access to the island is strictly prohibited for caravans, campers, motorhomes, and similar vehicles.<\/p>\n\n<p>7.9 The only roads with right of way are Viale Toni Gardin and the Fiordi main road.<\/p>\n\n<p><strong>Penalty: \u20ac 35.00<\/strong><\/p>\n\n<p>7.10 Maximum speed limit: 30 km\/h.<\/p>\n\n<p><strong>Penalty: \u20ac 50.00<\/strong><\/p>\n\n<p>7.11 For any matter not expressly regulated herein, the provisions of the Road Traffic Code shall apply.<\/p>\n\n<p><strong>Penalty: \u20ac 35.00<\/strong><\/p>\n\n<h2>Art. 8 \u2013 GENERAL PROVISIONS<\/h2>\n\n<ul>\n  <li>Any activity disturbing public peace is prohibited.<\/li>\n  <li>Sports activities must take place only in designated facilities.<\/li>\n  <li>Respect for flora and fauna is mandatory.<\/li>\n  <li>Camping and picnics in common areas are prohibited.<\/li>\n  <li>Pets must be kept on a leash.<\/li>\n  <li>Crossing the Golf Course is prohibited.<\/li>\n  <li>Abandoning waste is prohibited.<\/li>\n  <li>Displaying laundry and accumulating waste are prohibited.<\/li>\n  <li>Motorboat traffic is prohibited in the nautical area.<\/li>\n<\/ul>\n\n<p><strong>General Penalty: \u20ac 35.00<\/strong><\/p>\n\n<h2>Art. 9 \u2013 SECURITY SERVICE<\/h2>\n\n<p>9.1 The Security Service ensures compliance with these Rules.<\/p>\n\n<p>9.2 Security staff shall issue written reports for every violation.<\/p>\n\n<p>9.3 The most serious violations shall be reported to the Advisory Council.<\/p>\n\n<h2>Art. 10 \u2013 SANCTIONS<\/h2>\n\n<p>10.1 Violation of these Rules constitutes contractual breach.<\/p>\n\n<p>10.2 Collected penalties shall be received by the Comunione.<\/p>\n\n<p>10.3 Applicable penalties are:<\/p>\n\n<ul>\n  <li>\u20ac 35.00 for ordinary violations;<\/li>\n  <li>\u20ac 50.00 for violations involving golf cars and speed limits.<\/li>\n<\/ul>\n\n<p>10.4 Penalties must be paid the following day at the gatehouse.<\/p>\n\n<p>10.5 The obligation to pay applies to both the owner and the offender.<\/p>\n\n<p>10.6 Security staff may report unauthorized persons to the Judicial Authority.<\/p>\n\n<p>These Rules entered into force on 01\/01\/2020.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div
