Art. 1 – LEGAL STATUS OF THE ISLAND

1.1 Albarella is a residential island under private law.

Art. 2 – ADMITTANCE

2.1 The following persons shall have the right of admittance and stay on the island:

• property owners, including Albarella S.r.l.;
• close family members of the property owners.

2.2 The following persons shall obtain the right of admittance and stay on the island:

• property tenants and their family members as specified above;
• in general, any person allowed to stay on the island by property owners;
• guests staying at “Hotel Capo Nord” and “Golf Hotel”;
• persons staying on the island due to and for the execution of a continuous employment relationship with owners or tenants, limited to the duration of such service.

2.3 The following persons shall obtain the right of admittance and temporary presence on the island:

• persons carrying out activities on the island on behalf of owners or tenants, limited to the time necessary for such activities;
• in general, persons admitted to the island by property owners;
• owners of a mooring place at the Tourist Port of Albarella who have received a daily admittance permit from the Port Management.

Art. 3 – PASSES AND ACCESS CARDS – SECURITY CONTROLS

3.1 The right of admittance and stay on the island shall be documented through the issuance, by the Association, of personal and non-transferable access permits/passes.

All access methods are strictly subject to the existence and continuity of the following requirements:

• ownership of property on Isola di Albarella;
• rental agreement;
• employment relationship.

The loss of these requirements results in the loss of the right of access and the deactivation of the related access methods.

Penalty: € 35.00

3.2 Temporary access to the island shall be documented through the delivery of an access permit/pass indicating the validity period.

Penalty: € 35.00

3.3 Access permits/passes shall be issued by the Association upon submission of written declarations from owners or authorized adult family members.

3.4 Any person entitled to stay or temporary presence on the island must show the permit or communicate the access method to Security personnel.

3.5 Persons found on the island without the right of admittance and/or stay shall be requested to leave by Security personnel.

Art. 4 – ACCESS PERMITS/PASSES FOR MOTOR VEHICLES

4.1 Each property owner shall receive access permits/passes according to the following criteria:

FJORDS AND CONDOMINIUMS

One permit/pass for each parking space purchased together with the property.

LOTS (built and unbuilt)

Cubic meters (as calculated for condominium expenses)
DIVIDED BY
60 (legal cubic meters per person)
DIVIDED BY
3 (average number of persons per car)
ROUNDED UP

4.2 These permits/passes are non-transferable.

Penalty: € 35.00

4.3 Access permits/passes are valid yearly and issued only to owners who are up to date with condominium fee payments.

Art. 5 – ENFORCEMENT OF THE RULES

5.1 All owners are contractually bound to comply with these Rules.

5.2 Any person obtaining the right of admittance and stay from a property owner automatically accepts all provisions of these Rules.

5.3 All persons obtaining the right of admittance and/or stay are required to comply with all related provisions and sanctions.

5.4 The following signs must be displayed at the second gatehouse of the island:

• a sign indicating that the island is private property;
• a sign reading “Access reserved for authorized persons only”.

Art. 6 – PARKING AND TEMPORARY STOPS

6.1 Parking of motor vehicles on the island is allowed exclusively in parking spaces inside or pertaining to private properties.

Penalty: € 35.00

6.2 Temporary stops are always allowed for loading/unloading operations and work activities.

6.3 Persons without an available parking space must leave their vehicles in the external parking areas outside the island entrance.

Penalty: € 35.00

Art. 7 – TRAFFIC RULES

7.1 The ordinary means of transport on the island are:

• bicycles;
• community wheeled train;
• community shuttle bus;
• golf cars or quadricycles.

7.2 Motorized traffic is generally prohibited.

Penalty: € 35.00

7.3 Motorized circulation is permitted:

• for cars traveling to and from the assigned parking space;
• in emergency situations;
• for vehicles involved in work operations;
• for service and public authority vehicles.

7.4 Motorized circulation is tolerated:

• for cars after sunset;
• for mopeds and motorcycles during the permitted hours.

7.5 Golf cars must be driven by properly licensed persons and be insured.

Penalty: € 50.00

7.6 Golf cars must comply with civil coexistence rules and road signage.

Penalty: € 50.00

7.7 Golf car owners are required to register the vehicle.

Penalty: € 50.00

7.8 Access to the island is strictly prohibited for caravans, campers, motorhomes, and similar vehicles.

7.9 The only roads with right of way are Viale Toni Gardin and the Fiordi main road.

Penalty: € 35.00

7.10 Maximum speed limit: 30 km/h.

Penalty: € 50.00

7.11 For any matter not expressly regulated herein, the provisions of the Road Traffic Code shall apply.

Penalty: € 35.00

Art. 8 – GENERAL PROVISIONS

• Any activity disturbing public peace is prohibited.
• Sports activities must take place only in designated facilities.
• Respect for flora and fauna is mandatory.
• Camping and picnics in common areas are prohibited.
• Pets must be kept on a leash.
• Crossing the Golf Course is prohibited.
• Abandoning waste is prohibited.
• Displaying laundry and accumulating waste are prohibited.
• Motorboat traffic is prohibited in the nautical area.

General Penalty: € 35.00

Art. 9 – SECURITY SERVICE

9.1 The Security Service ensures compliance with these Rules.

9.2 Security staff shall issue written reports for every violation.

9.3 The most serious violations shall be reported to the Advisory Council.

Art. 10 – SANCTIONS

10.1 Violation of these Rules constitutes contractual breach.

10.2 Collected penalties shall be received by the Comunione.

10.3 Applicable penalties are:

• € 35.00 for ordinary violations;
• € 50.00 for violations involving golf cars and speed limits.

10.4 Penalties must be paid the following day at the gatehouse.

10.5 The obligation to pay applies to both the owner and the offender.

10.6 Security staff may report unauthorized persons to the Judicial Authority.
